So What is Due Process Anyway? Writing and Implementing Rules and Regulations.
Rules and regulations play an important role in the functioning of an association. Rules and regulations implemented by the board will stand up to judicial scrutiny when they do not conflict with state statute, the declaration, or the association’s bylaws. Further, there must be a procedure in place by which a homeowner can challenge any decision that they have violated a rule or regulation. And finally, any fine imposed must be reasonable. So how does a board go about drafting and implementing rules and regulations that meet all of these guidelines? This seminar will walk you through these requirements.
Mary Reiten is a member of Terrell Marshall Daudt & Willie PLLC (“TMDW”), where she concentrates her practice on real estate law, litigation, and class actions. Mary has significant experience representing both homeowners and condominium associations in complex disputes arising under Washington law. In addition, she has successfully represented clients in cases involving breach of purchase and sale agreements, timber trespass, and easements. Mary has been a member of WSCAI since 2006 and she currently serves on the Legislative Action Committee.
